The advent of e-discovery has given birth to a new field of ancillary litigation -- discovery about discovery. Parties are busy looking for what's missing, in the hopes of making their opponent "the spoliator".
Contributing to message board discussions is an effective and manageable expertise marketing tool, a way to stay in touch with the legal needs of the public, and a form of reputation management.
It's a touchy subject, but one worth broaching: Do business interests carry too much sway over federal judges? A recent panel discussion at New York University School of Law shed some light on this issue, and it seems that at least the Supreme Court appears to lean in favor of big business interests.
